Terms of Service
Terms governing Agency SMS Gateway accounts, Android/SIM infrastructure, billing, acceptable use, client deployments, third-party services, and messaging responsibility.

These Terms of Service govern access to Agency SMS Gateway (“ASG”), a Blue Sky AI Automation service. By purchasing, activating, accessing, or using ASG, you agree to these terms and to the policies referenced below.
1. Business service
ASG is intended primarily for business and agency use. You are responsible for the accuracy of your account information and for all activity performed through your agency, client, sub-account, devices, credentials, integrations, APIs, and carrier accounts.
2. Service description
ASG provides a managed software/service layer for connecting compatible Android + SIM-based SMS resources with supported GoHighLevel workflows, Conversations, campaign tools, APIs, webhooks, automation features, and related agency functions. Features may evolve over time.
3. Devices, SIMs, carriers, and third parties
Unless specifically stated in an order, you supply and manage Android hardware, SIMs, wireless service, internet access, GoHighLevel access, AI-provider credentials, and other third-party services. ASG relies on mobile carriers, device manufacturers, GoHighLevel, cloud/software providers, and other third parties we do not control.
4. Messaging consent and acceptable use
You must follow our Anti-Spam Policy and Responsible Messaging Policy. You are responsible for consent, opt-outs, required disclosures, messaging hours, content, recordkeeping, TCPA requirements where applicable, carrier policies, and all other laws and rules relevant to your recipients.
5. Account and security
Keep credentials, API keys, carrier accounts, devices, and GHL access secure. You are responsible for users and clients you authorize. Notify us promptly if you suspect unauthorized access or a compromised device/account.
6. Fees and billing
ASG subscription fees are based on the plan or order you select. Hardware, carrier service, taxes, payment processing, AI-provider usage, and other third-party charges are separate unless explicitly included in writing. Billing, renewal, cancellation, and any refund terms shown on your signed order, checkout, invoice, or service agreement control where they differ from this page.
7. Founding Agency pricing
Founding pricing is a limited launch offer for eligible agencies. Any price-lock promise applies only while the qualifying subscription remains continuously active and the account remains in good standing, subject to the final order/service agreement.
8. Suspension and termination
We may limit, pause, or terminate service where needed to address nonpayment, security issues, legal risk, carrier complaints, prohibited messaging, abusive use, attempts to evade safeguards, or material violations of these terms or referenced policies.
9. Delivery and availability
SMS delivery, timing, throughput, filtering, and phone-number status depend on carriers, recipients, devices, networks, and other third parties. We do not guarantee delivery of every message, uninterrupted device connectivity, a specific throughput, or continued carrier acceptance of a particular sending pattern.
10. AI and knowledge-base features
If you enable AI-assisted features, you are responsible for the source content, prompts, outputs, third-party AI-provider account, and how AI-generated responses are used. Review automated outputs before relying on them for regulated, financial, legal, medical, or other high-stakes communications.
11. Intellectual property
ASG branding, website content, service design, and materials supplied by us are protected by applicable intellectual-property laws. You retain ownership of your agency/client data and materials, subject to the rights needed for us and our service providers to operate and support the service.
12. Disclaimer
The service is provided on an “as available” basis to the extent permitted by law. ASG does not provide legal advice and does not guarantee that using a particular transport method makes a campaign compliant with law or carrier rules.
13. Limitation of responsibility for third parties
We are not responsible for outages, policy changes, filtering, suspensions, fees, or other actions by mobile carriers, GoHighLevel, device vendors, hosting providers, AI providers, payment processors, or other independent third parties.
14. Changes
We may update these terms as the service evolves. The effective date shown at the top identifies the current version.
